1. Introduction

Welcome to Fit & Flow Mom Club, operated by Mommy & Me Yoga Club LLC (“Fit & Flow,” “we,” “us,” or “our”).

These Terms & Conditions (“Terms”) apply to your use of www.fitandflowmomclub.com, our booking and payment systems, and your purchase of or participation in classes, events, child watch offerings, class packs, and other services offered by Fit & Flow Mom Club (collectively, the “Services”).

By purchasing or registering for a Service, you agree to these Terms and any additional policies, waivers, or event-specific conditions presented during registration.

2. Registration and Eligibility

You must be at least 18 years old to make a purchase or registration through Fit & Flow Mom Club unless otherwise permitted by us.

Parents and legal guardians are responsible for registering minor children and for providing accurate information regarding any children included in their registration.

You agree to provide current and accurate information when registering and to update that information when reasonably necessary.

3. Participation, Health, and Safety

Yoga, Pilates, fitness, prenatal movement, and other physical activities involve inherent risks.

You are responsible for determining whether you and any child participating with you are physically able to participate in a particular class or activity.

Fit & Flow instructors are movement and fitness professionals, not medical providers, and participation in our Services is not a substitute for medical advice, diagnosis, or treatment.

If you are pregnant, postpartum, recovering from an injury or procedure, have a medical condition, or have questions about whether a particular activity is appropriate for you, you should consult an appropriate healthcare professional when necessary.

Please inform your instructor of relevant injuries, limitations, pregnancy considerations, or other concerns that may affect your participation.

You are responsible for listening to your body, choosing appropriate modifications, and stopping any activity that causes pain, dizziness, unusual discomfort, or other concerning symptoms.

Participation may also be subject to a separate Participant Agreement, Assumption of Risk, and Release of Liability presented during registration.

4. Children at Fit & Flow Classes

Children are welcome at designated Fit & Flow Mom Club classes and events as described in the applicable listing.

Unless child watch is specifically offered, parents and guardians remain responsible for supervising their children throughout the class or event.

Children may play nearby, remain with their parent, be held, or participate when appropriate for the particular class and their age.

Because our classes take place in shared movement spaces, parents and guardians are responsible for helping keep children safely away from equipment, walkways, other participants, and any areas identified by the instructor or venue as restricted.

5. Child Watch

Fit & Flow Mom Club may offer optional child watch during select classes.

Child watch consists of supervised play in a designated nearby area while the parent or guardian participates in class. It is provided as a convenience to participants and is not drop-off childcare or daycare.

Parents and guardians must remain on-site and reasonably available throughout the class.

Child watch staff do not provide feeding, diapering, medication administration, or other personal care. If a child needs their parent or guardian, the participant may step away from class at any time.

Children are still welcome at designated Mommy & Me classes when child watch is not offered. Child watch is an additional option at select classes, not a requirement for bringing a child.

Additional child watch terms or waivers may apply during registration.

6. Booking, Payment, and Class Packs

Classes, events, child watch, and other Services may be booked through our website or another authorized Fit & Flow booking platform.

Unless otherwise stated, payment is due at the time of registration.

Fit & Flow Mom Club may offer a 4-Class Pack at a discounted rate.

The 4-Class Pack:

Includes four eligible Fit & Flow Mom Club classes
Must be used within three months of purchase
Is intended for use by the purchaser and is not transferable unless approved by Fit & Flow Mom Club
May not apply to special events, pop-ups, partner events, or other offerings specifically excluded from class packs
Is non-refundable once purchased after any cancellation period required by applicable law.

Unused classes expire at the end of the three-month validity period.

Prices, availability, inclusions, and class details are subject to change. The price and terms shown at the time of purchase will apply to that purchase, subject to applicable law.

7. Cancellations, Rescheduling, Credits, and Refunds

Fit & Flow Mom Club does not provide refunds for participant-initiated cancellations or missed classes, except where otherwise required by law.

If you are unable to attend a class or event you booked, please contact us as soon as possible. Depending on the type of booking and availability, we may allow you to:

Reschedule your registration to another eligible class or date
Apply the amount paid as a credit toward another eligible Fit & Flow Mom Club class

Rescheduling and credits are subject to availability and may not be available for certain special events, limited-capacity experiences, partner events, or offerings with event-specific policies.

For classes booked using a 4-Class Pack, an approved reschedule will return the class credit to your pack, provided the pack has not expired. The original three-month expiration date of the class pack still applies.

No-shows or requests made after the applicable class or event may result in the loss of the registration or class credit.

If Fit & Flow Mom Club cancels a class or event, participants will be offered an appropriate reschedule, credit, transfer, or refund.

8.Weather, Venues, and Schedule Changes

Fit & Flow Mom Club operates at a variety of partner venues throughout Southwest Florida.

Classes and events may be affected by weather, venue availability, instructor illness, safety concerns, low enrollment, or circumstances outside our reasonable control.

Some outdoor classes may move indoors when an appropriate indoor space is available. Event-specific weather information will be included in the applicable listing when relevant.

We reserve the right to modify instructors, locations, schedules, programming, or event details when reasonably necessary.

Participants are also responsible for following reasonable rules and safety requirements established by the host venue.

9. Outdoor Classes and Special Events

Fit & Flow Mom Club may offer outdoor classes, fundraisers, family events, pop-ups, and other specialty experiences.

Outdoor locations may involve uneven ground, grass, sand, heat, sun exposure, insects, weather changes, or other environmental conditions.

Participants are responsible for bringing appropriate clothing, footwear, hydration, sun protection, or other items recommended in the event description.

Event-specific instructions and policies will apply in addition to these Terms.

10. Conduct and Community Standards

Fit & Flow Mom Club is intended to provide a welcoming and respectful environment.

Participants agree to:

Treat instructors, staff, venue partners, children, and other participants respectfully
Follow reasonable safety instructions from instructors and venue staff
Supervise their children unless the child is actively participating in Fit & Flow childwatch
Avoid behavior that is threatening, discriminatory, unsafe, intentionally disruptive, or harmful to others or property

We reserve the right to ask an individual to leave a class or event or restrict future participation when reasonably necessary to protect participants, staff, venues, or the Fit & Flow community.

11. Photography and Video

Fit & Flow Mom Club frequently photographs or records classes and events for business, marketing, social media, website, advertising, and promotional purposes.

Where consent is required, photography and video permissions are addressed through our registration process, participant agreement, photo release, event documentation, or another consent mechanism.

Parents or guardians are responsible for providing any required permission relating to their minor children.

If you have questions about photography at a particular class or event, please contact us before attending or speak with the Fit & Flow team when you arrive.

12. Intellectual Property

The Fit & Flow Mom Club name, logos, branding, website content, photographs, graphics, videos, written materials, original class materials, and other proprietary content are owned by Mommy & Me Yoga Club LLC or used with permission, as applicable.

You may not reproduce, distribute, publish, sell, modify, commercially exploit, or represent our proprietary materials as your own without prior written permission.

Nothing in these Terms prevents others from independently offering yoga, Pilates, fitness, Mommy & Me, prenatal, or similar movement services. These Terms prohibit unauthorized use of our protected branding and proprietary materials, not independently created services or concepts.

13. Website and Third-Party Services

Our website and Services may use or link to third-party platforms for functions such as booking, payments, forms, maps, social media, email communications, or venue information.

Third-party services may be governed by their own terms and privacy policies.

While we choose providers intended to support our business operations, we cannot guarantee the continuous availability or performance of third-party systems.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

15. No Guarantee of Results

Individual experiences and fitness outcomes vary.

Fit & Flow Mom Club does not guarantee any particular fitness, wellness, strength, weight, health, pregnancy, postpartum, or other result from participation in our Services.

16. Assumption of Risk and Limitation of Liability

Participation in physical activity involves inherent risks.

Participants may be required to agree to a separate Assumption of Risk and Release of Liability as part of the registration process.

To the fullest extent permitted by applicable law, Fit & Flow Mom Club and Mommy & Me Yoga Club LLC are not responsible for losses or damages resulting from risks inherent in participation, failure to follow safety instructions, misuse of facilities or equipment, or circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Mommy & Me Yoga Club LLC, doing business as Fit & Flow Mom Club, and its owners, instructors, employees, contractors, and agents from claims, losses, or expenses arising from your violation of these Terms or your unlawful or intentional misconduct.

18. Changes to These Terms

We may revise these Terms from time to time to reflect changes to our Services, business practices, or legal requirements.

The Last Updated date at the top of this page will reflect the most recent revision.

Changes will apply prospectively unless otherwise required by law.

19. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute relating to these Terms will be subject to applicable Florida and federal law and any legally applicable jurisdiction or venue requirements.

21. Entire Agreement

These Terms, together with our Privacy Policy, applicable participant waivers, booking policies, childwatch agreements, and any terms disclosed for a particular class or event, constitute the agreement governing your purchase and use of the applicable Services.

If an event or booking contains specific terms that differ from these general Terms, the more specific terms will apply to that purchase to the extent of the difference.
